Data Collected
We collect name, email address, phone number, project interest, budget range, and message content submitted through the contact form. We do not collect special category data, financial records, or health information.
Purpose of Processing
Personal data is processed solely for the purpose of responding to inquiries, providing service quotations, and executing agreed-upon design projects. Data is not used for automated decision-making or profiling.
Legal Basis
Processing is based on consent (Art. 6(1)(a) GDPR) provided when submitting the contact form, and on legitimate interest (Art. 6(1)(f) GDPR) for responding to pre-contractual inquiries.
Data Retention
Contact form data is retained for 12 months from the date of submission. Project-related data is retained for the duration of the engagement plus 6 years as required by Portuguese tax law.
Data Sharing
Personal data is not sold, rented, or shared with third parties except as required by law or with explicit consent. Infrastructure providers (hosting, email) act as data processors under contract.
Your Rights
Under GDPR, you have the right to access, rectify, erase, restrict processing, object to processing, and port your data. To exercise these rights, contact [email protected]. You also have the right to lodge a complaint with the Portuguese Data Protection Authority (CNPD).
International Transfers
Data is processed within the European Economic Area (EEA). If any processing occurs outside the EEA, appropriate safeguards under Chapter V of the GDPR (Standard Contractual Clauses) will be applied.
Scope of Services
ModernCanvasForge provides web design, visual asset production, UI/UX systems, brand identity, e-commerce storefronts, landing page funnels, motion design, and SEO services as described on this website. Each engagement is governed by a separate project agreement.
Pricing & Payment
All prices displayed are fixed quotes in Euros (€). Payment terms are defined in individual project agreements. Invoices are due within 14 days of issuance unless otherwise agreed in writing.
Intellectual Property
Upon full payment, all deliverables and intellectual property rights transfer to the client. ModernCanvasForge retains the right to display completed work in its portfolio unless otherwise agreed in the project agreement.
Project Timelines
Estimated timelines are provided in good faith and begin from the date of project kickoff and receipt of all required materials. Delays in client-provided assets may extend delivery dates proportionally.
Limitation of Liability
ModernCanvasForge's total liability shall not exceed the total fees paid by the client for the specific project. We are not liable for indirect, incidental, or consequential damages arising from the use of delivered work.
Governing Law
These terms are governed by the laws of Portugal. Any disputes shall be resolved through the courts of Aveiro, Portugal, unless otherwise agreed in the project agreement.
Refund Eligibility
Refund requests are evaluated on a case-by-case basis. Full refunds are available within 7 days of project kickoff if no design work has commenced. Partial refunds are proportional to remaining undelivered milestones.
Non-Refundable Items
Work already delivered and approved by the client is non-refundable. Rush fees, third-party licensing costs, and domain registration fees are non-refundable once incurred.
Refund Process
To request a refund, contact [email protected] with your project reference. Refunds are processed within 14 business days to the original payment method. A written refund confirmation will be provided.
Dispute Resolution
If a refund dispute cannot be resolved directly with ModernCanvasForge, either party may seek resolution through the Portuguese consumer arbitration boards or the courts of Aveiro, Portugal.
